In this agreement, the Seller is also referred to as "Zolpix".
1.2. Buyer: the person who places the order on zolpix.com and uses their email address or account on the checkout page. The Buyer's email address and, if any, account details are included in the order record.
Article 2. Definitions
- Service: the provision to the target of the engagement included in the ordered package.
- Package terms: the start time (labelled "Start time" on the site), delivery time (labelled "Completion time" on the site), refill condition, refund condition and notes shown on the package page and the checkout page.
- Target: the platform account or content whose link the Buyer gives in the order.
- SMM service provider: a third-party service provider with which the Seller has an agreement for performing the service.
- Durable medium: a means (e.g. email) that enables information sent to the Buyer to be stored in a way that allows it to be examined for a reasonable period and copied unchanged.
Article 3. Subject of the agreement and order-specific information
3.1. The subject of the agreement is the performance by the Seller of the service included in the package ordered by the Buyer, and the payment of its price by the Buyer. The service is the provision, for a target on platforms such as Instagram, TikTok, YouTube, X, Facebook and Telegram, of engagement such as followers, subscribers, members, likes, views, comments, reach, saves or shares in the quantity stated in the package. The service is performed electronically; no physical product is sent.
3.2. The order-specific information, namely the order number, the Buyer's email address, the platform, service type and quantity of each package, the target link, the package terms, the unit and total price, any coupon discount, the currency charged and the exchange rate applied, and the payment method, is shown on the checkout page before the order is confirmed and is sent to the Buyer in the order confirmation email after the order has been confirmed.
3.3. The package terms published at the moment the order is placed and the version of this agreement in force at that moment apply to the order. Later changes made by the Seller do not affect orders already placed.
3.4. Apart from what is expressly stated in the package terms, the Seller makes no commitment about the nature of the accounts that carry out the engagement, how long the engagement lasts, or its effect on the target's reach, visibility, income or platform algorithms. The Seller is not affiliated with the platforms.
Article 4. Conclusion of the agreement
4.1. The agreement is concluded once the Buyer, on the checkout page, has confirmed having read the Pre-Contractual Information Form, has accepted this agreement and has completed the "Place order" step, which creates an obligation to pay.
4.2. The Seller confirms receipt of the order to the Buyer by email without delay (Law No. 6563 Art. 4). The order confirmation email, which the Seller sends before passing the order to the SMM service provider, contains, as a durable medium, the version of this agreement and of the Pre-Contractual Information Form accepted by the Buyer, together with the order-specific information.
4.3. If the card payment cannot be completed, or if no bank transfer notification is made within the period shown in the payment instructions for bank transfers, the order is closed as unpaid; in that case, the service is not performed and no obligation to pay or to perform arises for the parties.
Article 5. Price and payment
5.1. The base price of packages is in Turkish lira. The total amount shown on the checkout page is the total price, including all taxes, that the Buyer will pay. The Seller does not charge any additional amount such as a shipping, service or transaction fee. The amount and exchange rate shown on the checkout page are valid for the period stated on the page; if the period expires, the current amount is shown and the Buyer's confirmation is obtained again.
5.2. Payment methods:
- Card: Payment is made on the payment page of the contracted payment institution. Card details are not passed to the Seller and are not stored by the Seller. For card payments, the charge is made in the currency shown on the checkout page; currencies other than Turkish lira are offered only when supported by the payment institution and when a valid exchange rate is available.
- Bank transfer (havale/EFT): Offered only in Turkish lira and only on the Turkish-language site. The Buyer makes the payment to the account shown in the payment instructions, using the amount and description shown, and sends the bank transfer notification. The bank transfer notification is not proof of payment; payment is finalised when the Seller verifies the bank transaction. If no bank transfer notification is made within the period shown in the payment instructions (72 hours as at the date of this version), the wait for payment ends; if a notification has been made within that period, the payment remains open until the Seller's review is concluded.
- Account balance: Can be used by account holders with a verified email address for orders with an amount in Turkish lira. The total amount is deducted from the balance; balance cannot be combined with another payment method in the same order.
- Payment in crypto-assets is not accepted.
5.3. Payment is finalised only by a verified notification from the payment institution, by a query to the payment institution or by verification of the bank transaction.
5.4. Exchange rate differences and fees that the Buyer's bank may apply when paying in a foreign currency or with a card issued abroad are outside the Seller's control.
Article 6. Performance of the service
6.1. After the payment has been finalised, the Seller passes the order to the SMM service provider and begins performance. The start and delivery times are shown in the package terms; the delivery time shown is the maximum time within which the order will be completed. The Seller performs the service in accordance with these times and the package terms.
6.2. The payment status and the delivery status of the order are shown separately: for account holders, in the orders section of the account; for guest buyers, on the Order tracking page.
6.3. If performance of the service becomes impossible, the Seller notifies the Buyer by email within three days of the date it learns of this, and refunds the part of the price collected that relates to the part that cannot be performed within 14 days at the latest of the date of notification.
6.4. If the service is not performed within the time in the package terms, is performed incompletely or does not conform to the package terms, the service is deemed defective (Law No. 6502 Art. 13). Under Article 15 of Law No. 6502, the Buyer may choose one of the following rights: re-performance of the service (e.g. completion of the missing part), a price reduction proportionate to the defect, or rescission of the contract; the Seller provides the remedy chosen by the Buyer. The Buyer's right to compensation under the general provisions of law is reserved.
6.5. The delivered quantity is recorded according to the SMM service provider's report. The Buyer may object to this record; the Seller reviews the objection and notifies the Buyer of the outcome.
Article 7. Right of withdrawal
7.1. The Buyer has the right to withdraw from the agreement within 14 days of the day it is concluded, without giving any reason and without paying any penalty (Law No. 6502 Art. 48; Distance Contracts Regulation Art. 9).
7.2. Exception to the right of withdrawal: Under sub-paragraphs (ğ) and (h) of the first paragraph of Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services performed instantly in electronic form or for services whose performance begins with the consumer's consent before the withdrawal period ends. By ticking a separate consent box on the checkout page that is not pre-ticked, the Buyer expressly requests that performance of the service start within the withdrawal period, immediately after the payment is finalised, and acknowledges that they will lose the right of withdrawal once performance has begun. An order cannot be placed unless this box is ticked. The consent is stored with the order, together with the time of consent and the version of the text consented to.
7.3. The right of withdrawal can therefore be exercised until performance begins. Notices of withdrawal made while the delivery status of the order is "Not submitted" (e.g. while a bank transfer payment has not yet been verified), or while the Seller has not yet passed the order to the SMM service provider, are accepted. Once performance has begun, the right of withdrawal cannot be exercised; however, the rights under Articles 6.3 and 6.4 are reserved.
7.4. The notice of withdrawal is given within the withdrawal period by a clear statement: by email to info@zolpix.com, to the Seller's KEP address if any, or in writing to the Seller's address in Article 1.1. The attached withdrawal form may be used; its use is not mandatory. Stating the order number and the email address used in the order in the notice speeds up processing.
7.5. The Seller refunds the full price collected within 14 days at the latest of the date the notice of withdrawal reaches it, in a manner appropriate to the payment method used by the Buyer and without any cost to the Buyer (Distance Contracts Regulation Art. 12). Payments made by bank transfer are refunded to a bank account, notified by the Buyer, belonging to the account holder who made the payment. If the Buyer expressly asks and has an account, the refund can be made to the account balance.
7.6. Consumers living in the European Union: If the Buyer's habitual residence is in a member state of the European Union, the following rule applies instead of Articles 7.2 and 7.3: the Buyer may exercise the right of withdrawal until the service has been fully performed. Once a service whose performance began at the Buyer's express request and with the Buyer's acknowledgement on the checkout page has been fully performed, the right of withdrawal cannot be exercised (Directive 2011/83/EU Art. 16(a)). If the Buyer withdraws while performance is in progress, the Buyer pays the price of the part performed up to the moment the notice of withdrawal reaches the Seller, calculated in proportion to the whole of the contract (Art. 14(3)); the Seller deducts this amount and refunds the remaining price under Article 7.5.
Article 8. Refill and refunds
8.1. Refill for engagement that drops after delivery is provided only if a refill period and scope are shown in the package terms, and only within those terms. If refill is not shown in the package terms, later drops are not refilled.
8.2. The detailed rules on cancellation, refunds, partial delivery, short or excess bank transfer payments and refunds of balance top-ups are in the Refund and Cancellation Policy, which forms part of this agreement.
Article 9. Obligations of the Buyer
9.1. The Buyer must enter the target link correctly and of the type the package requires; be the owner of the target or have obtained the owner's permission; until delivery is complete (and, if refill applies, for the refill period), keep the target public, not delete it and not change its username; and not receive the same type of engagement for the same target from another source at the same time.
9.2. The Buyer is responsible for complying with the target platform's rules and for using the engagement bought in a lawful manner. A delivery shortfall arising from the Buyer's breach of Article 9.1 is not a failure of performance by the Seller.
9.3. The Buyer must never give their social media password or verification code to the Seller or anyone else. The Seller never asks for this information.
Article 10. Obligations of the Seller
10.1. The Seller must perform the service in accordance with the package terms and this agreement, show the payment and delivery status correctly, meet its refund obligations on time and process the Buyer's personal data in accordance with the legislation.
10.2. The Seller may refuse or cancel the order before delivery starts in the cases in Article 6.4 of the Terms of Use; in that case, it refunds the full price collected within 14 days at the latest of the date of refusal or cancellation.
Article 11. Personal data
The Buyer's personal data are processed in accordance with the Personal Data Processing Notice and the Privacy Policy. For performance of the order, only the target link, quantity, service code and order reference are passed to the SMM service provider.
Article 12. Force majeure
During events beyond the parties' control (such as natural disasters, war, epidemics, widespread power or internet outages, decisions of competent authorities, or technical changes by platforms that generally prevent the service), the parties' obligations are suspended. The price of the part that cannot be performed because of force majeure is refunded under Article 6.3.
Article 13. Records and evidence
The Seller keeps records of the conclusion of the agreement, the text versions accepted, and payment and performance for the period provided for in the legislation. These records may be submitted as evidence in disputes; the Buyer's right to submit evidence to the contrary is reserved.
Article 14. Complaints and dispute resolution
14.1. The Buyer may send complaints to info@zolpix.com or through the support channels published on the site. The Seller reviews complaints and notifies the Buyer of the outcome.
14.2. This agreement is governed by the law of the Republic of Türkiye. In disputes, the Buyer may apply, within the monetary limits announced each year by the Ministry of Trade, to the consumer arbitration committee of the Buyer's place of residence or of the place where the transaction was carried out, and, in disputes exceeding these limits, to the consumer court (Law No. 6502 Art. 68 and Art. 73). Before a case is filed at the consumer court, applying to a mediator is mandatory (Law No. 6502 Art. 73/A).
14.3. If the Buyer's habitual residence is in a country of the European Union, the rights granted to the Buyer by the consumer law of that country that cannot be excluded by contract are reserved; with regard to the right of withdrawal, Article 7.6 applies.
Article 15. Entry into force
This agreement is concluded and enters into force when the Buyer gives consent on the checkout page and confirms the order. The version of the agreement accepted by the Buyer is stored with the order and is sent to the Buyer in the order confirmation email in accordance with Article 4.2.
